Terms of Service

These Terms of Service ("Terms") govern your use of MixID at www.mixid.fm, operated by Rekordcloud B.V., a private limited company registered in the Netherlands (the "Service", "we", "us", "our").

By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

MixID identifies the tracks played in DJ mixes by analysing publicly available audio (for example, YouTube videos you submit) and matching it against a music catalogue. Results, including artist, title, BPM, and key information, are returned to you and may also be displayed on a public mix page.

2. Accounts

You are responsible for keeping your password secret and for all activity that occurs under your account. Notify us immediately at hi@rekord.cloud if you suspect a breach. You must provide accurate registration information and you must be at least 16 years old to create an account.

We may change, reclaim, or reassign any username at any time and at our sole discretion — for example, where a username impersonates another person, brand, or MixID itself, is misleading, offensive, or infringes someone's rights, or where we need it to operate the Service. Where practical we will assign a reasonable alternative, but we are not required to give you notice. You have no ownership of, or continuing right to, any particular username.

3. Content you contribute

When you submit a mix or annotate one, you provide us with:

• The YouTube URL or other source link.
• Optional metadata (title, your suggested track identifications, transitions, votes, highlights).

You retain ownership of what you contribute. By submitting it to the Service, you grant Rekordcloud B.V. a worldwide, royalty-free, non-exclusive licence to host, store, display, transmit, and analyse that content for the purpose of operating, improving, and promoting the Service and other Rekordcloud products. The licence ends when you delete the content (or your account), except for backup copies or copies already incorporated into aggregate or anonymised statistics.

You represent that you have the right to submit the content and that submitting it does not violate any third party's rights, including copyright, trademark, or privacy rights. You are solely responsible for the legality of the URLs you submit.

4. Acceptable use

You agree not to:

• Use the Service to infringe anyone's intellectual-property rights or to upload illegal content.
• Reverse engineer, scrape, or attempt to extract the underlying source code, models, or fingerprint catalogue.
• Interfere with the Service's normal operation, including by automated abuse, denial of service, or evasion of rate limits.
• Impersonate another person, harass other users, or post abusive content in any free-text field.
• Resell, sublicense, or commercially exploit the Service or its output without our written permission.

5. Links to other sites

The Service may link to third-party sites or services (YouTube, Beatport, Spotify, Apple Music, Tidal, SoundCloud) that we do not own or control. We are not responsible for the content, privacy practices, or terms of those sites. Use them at your own risk.

6. No guarantee of results

Track identification is probabilistic. We do not guarantee that every track in a mix will be identified, that identifications will be correct, or that any specific result will be reached. Decisions you make based on MixID output are your own responsibility.

7. User responsibility

You are responsible for the consequences of submitting content to the Service, including any takedown requests, copyright disputes, or third-party claims arising from your submissions.

8. Termination

We may suspend or terminate your account, and remove or restrict your access to the Service, immediately and without prior notice, if you breach these Terms or if we reasonably suspect fraud, abuse, or other unlawful activity. We may also discontinue the Service in whole or in part at any time. Upon termination your right to use the Service ends immediately.

9. Limitation of liability

To the maximum extent permitted by law, in no event shall Rekordcloud B.V., its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

10. Force majeure

We are not liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, war, terrorism, civil unrest, government action, labour disputes, network outages, or failures of third-party providers.

11. Indemnification

You agree to defend, indemnify, and hold harmless Rekordcloud B.V. and its affiliates, licensors, and service providers from and against any claims, damages, obligations, losses, liabilities, costs, or debts arising from (a) your use of the Service, (b) your breach of these Terms, or (c) content you submitted.

12. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

13. Governing law

These Terms shall be governed by the laws of the Netherlands, without regard to its conflict-of-law provisions. The competent courts of the Netherlands have exclusive jurisdiction over any dispute arising from these Terms or the Service.

14. Changes

We reserve the right to modify these Terms at any time. If a change is material we will give you at least 30 days' notice before it takes effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
